Warranties
Our non-contentious construction team has considerable experience advising employers, funders and contractors on all aspects of UK property projects. We have drafted a suite of unified project documents including building contract, professional appointment, collateral warranties and ancillary construction documents such as guarantees and bonds for use on UK property projects.
With regard to collateral warranties, we have produced our standard form warranty which works with the building contract and professional appointments on UK property projects. Often our clients who fund the property projects do not accept net contribution clauses and our collateral warranties are drafted so that the core funder is not out of pocket when a project professional becomes insolvent through no fault of the employer or funder.
Some examples of our work include:
- Acted for the developer on the Resi Award 2016 winning Development in Mayfair, London which consisted of seven exceptionally high quality luxury apartments. Advised on all legal aspects of the development including acquisition, development and planning, funding, construction and onward sales.
- Acted for a UK based Hotel Group on developments in London, Manchester and Leeds. Advice included drafting and negotiating all building contracts, professional appointments and associated documents for each development. The two London Hotels at the time of construction, 2010, were the largest new build hotel construction projects in London.
- Negotiated the building contact and professional appointments and associated collateral warranties for a casino operator on two projects, one in the North of England and the other in Wales.
- Acting for the developer of a high-end residential project. Drafting and negotiating the Building contracts and all associated construction documents for their prestigious project. The planning permission allows for the retention of the façade and the rebuilding of the main house and mews building to eight self-contained residential units.
