Where termination of employment is contemplated we can guide the business through that process, including whether it might be appropriate to have a protected pre-termination negotiation to agree an exit with an employee as an alternative option to carrying out a formal process. This guidance will be tailored to the individual circumstances and can include scripts for difficult discussions and preparing and advising on the use of a settlement agreement.
We also understand when such processes can become complex with the introduction of grievances and can guide the business on how to ‘keep on track’ without being diverted.
We have a great depth of experience in managing grievances including multiple grievances and managing employee relations, advising on personnel to manage investigations and grievance hearing and when to instruct a third party to assist with the management of the process, including in the provisions of independent investigation services.
Frequently discrimination and whistleblowing issues arise in grievance and disciplinary processes and we are adept at dealing with such matters.
