Tara is an Associate in the Property Litigation team at Edwin Coe LLP. She advises on a broad spectrum of residential and commercial property disputes and has developed a particular specialism in matters arising under the Building Safety Act 2022.

Tara is known for her commercially astute and pragmatic approach to litigation. She is committed to keeping clients fully informed throughout the process and places great emphasis on building strong working relationships. Her goal is to ensure that navigating disputes is as straightforward and stress-free as possible and that advice is presented in a clear and succinct manner.

 

In her practice, Tara advises a variety of clientele including housebuilders/developers, small to medium sized UK and BVI companies and individuals (including high-net and ultra-high net worth individuals and non-UK domiciled individuals).

 

Tara’s practice is far reaching and includes, but is not limited to:

  • Rights of Way and Boundary Disputes.
  • Service Charge and Restrictive Covenant Disputes.

  • Building Safety Act 2022 matters – including advisory work on the certification regime and leaseholder/landlord obligations, Higher Risk Buildings, Remediation Orders, Remediation Contribution Orders, Building Liability Orders and Defective Premises Act 1972 claims.
  • Professional Negligence claims particularly against surveyors, tax advisors/accountants and solicitors.

 

Tara also has experience on the transactional side of property having previously assisted with plot sales and site setups, as well as commercial and residential property transactions during her training contract. Tara’s dual expertise in both contentious and non-contentious property matters empowers her to tailor her advice and approach to each client’s unique needs

EXPERIENCE
Tara’s experience includes:
Advising a large UK lender on the risk posed by numerous types of residential tenancies for a high rent security at a mixed-use building including regulated tenancies, council tenancies, service agreements, AST’s and
Obtaining possession of an apartment in Kensington under a common law tenancy with rent arrears of circa £112,000.
Recovery of rent arrears and dilapidation costs of circa £300,000.
Obtaining possession of numerous properties under both Section 21 and Section 8 Housing Act 1988 from issue of the notice to a fully contested hearing/trial.
Advising social housing providers, right to manage companies and leaseholders on their liabilities under the Building Safety Act 2022 and enforcement options to pass on cladding remediation costs to the responsible entities.
Advising a residential management company at a block of 35 flats on their obligations under the BSA 2022 at a higher risk building.
Advising a freeholder of 6+ higher risk buildings on a large marina along the south coast on landlord certificates and their liability under the BSA where vast cladding, structural defects and compartmentation issues were present.
Assistance with navigating negotiations and disputes between leaseholders, managing agents and RTM’s over lease breaches, structural alterations, service charge and property repairs at high value premises located in Belgravia.
