Roger heads up the firm’s Insurance and Insurance Disputes Group.

He has represented policyholders in complex coverage disputes across an array of industry sectors, including:  construction matters, claims for professional negligence, directors’ and officers’ liability, shareholder claims and general property and business interruption losses.  As head of the Edwin Coe insurance team, Roger leads a group of technically excellent, committed professionals with a proven track record of success.

 

Roger is a partner practicing in the areas of insurance and litigation, and the preeminent insurance team he leads is recognised in all the leading directories.  He is variously described in Chambers UK and the Legal 500 as a “brilliant negotiator” with “very sound judgment” and a lawyer who is “decisive and in control of the whole process.”

 

He has extensive experience of a wide variety of policyholder disputes and takes a hands-on, collaborative approach to all aspects of a client’s claim, from deploying aggressive recovery strategies to funding and mediation.  His experience in the market means that many of his cases are resolved successfully long before trial, often with the involvement of related claims against insurance brokers for under-insured or uninsured losses.  This latter aspect of his practice means that Roger is also one of the leading authorities on broker negligence cases.

 

Roger serves as a member of the firm’s Management Committee and is a frequent speaker on insurance and litigation topics in the UK and internationally. He qualified in 1999 and became a partner in 2005.

Acting for various hospitality groups in the leading test cases on Covid-19 Business Interruption losses.
Acting for a private equity funded hotel group in relation to coverage under a buyer-side warranty and indemnity policy.
Acting for the Claimant Plc in a claim for material damage/business interruption losses involving a misrepresentation argument over sums insured across 20 premises.
Advising the Claimant insured where the insurer denied cover on an all-risks policy relying on an alleged breach of condition and “unexplained loss” and fidelity exclusions.
Acting for the Claimant property developer in a claim under a premier guarantee policy relating to structural warranties.
Acting for the Claimant property investment fund in a claim against its insurance broker for negligent advice on the interaction between its Master Policy and local CAR policy.
Acting for the Claimant waste (WEE) recycling business in a claim against insurers and the insurance broker. The judgment provided an interesting summary of, and extension to, the duties owed by the broker in relation to advice on the disclosure of material facts.
