Our construction team has considerable experience advising all parties to the construction process on engineering contracts including but not limited to FIDIC engineering contracts, NEC engineering contracts, and various bespoke engineering contracts.
Many engineering projects are project finance schemes where timely project completion is of utmost importance.
Our Construction partner Stuart Nash was a member of the Society of Construction Law Disruption and Delay Protocol drafting panel and on behalf of employers, often amends the intercity standard form contracts in order to make them “protocol compliant”. Once the contract is protocol complied it is far easier to monitor the contractor’s progress and to ensure timely project completion.
Examples of our work include:
- Acted for a UK NHS Trust on the negotiation of the Project Agreement for the design, build, operation and maintenance of an energy centre for a term of 15 years.
- Advising a UK port operator on its change/order variations disputes arising under ICE based contract for the construction of a warehousing and distribution centre.
- Acted for the Employer of the Cotton Development Centre and drafted the engineering contract, the Operations and Maintenance Agreement and the Monitoring and Testing Agreement for this 400 MW power station in the Midlands.
