The Chartered Institute of Arbitrators is planning to launch a new service for hearing property disputes covering the following:

• Property and ownership interference
• Boundaries or nuisance by noise
• Professional disputes claims against professionals for negligence
• General issues regarding easements and rights of way

The purpose of this service is to try and provide quicker and more cost effective alternatives to traditional litigation.

The Chartered Institute of Arbitrators has confirmed that the aim is to offer an impartial and independent service and that it will only appoint its own members to act as neutral third parties, being Arbitrators who are experienced and qualified to the highest level.

Given the recent changes to the Court system with the inevitable result of a front loading in costs, this is a very interesting alternative to the Court process. However, disputes could only be referred with the consent of both parties and it is important to proceed with caution in particular over the choice of Arbitrator.
