As we highlighted in our blog on 20/10/17, following the abolition of Tribunal fees, the Government had put in place its first stage of plans to refund everyone who has paid a fee to bring an Employment Tribunal (ET).

This month the Government published a letter from the Secretary of State for Justice to the House of Commons Justice Committee which provided an update on progress of the refunding of ET fees since the abolition of fees on 26 July 2017.

The Government had estimated that the total refund amount would be around £33 million, £17 million of which was anticipated to be refunded in 2017/18. However, the statistics confirm what we have long suspected, that refund applications have fallen well short of the initial estimation. The reason for this shortfall is not certain but the Government has stated that “further action is necessary… to raise awareness of the existence of the [refund] scheme”. So we are doing just that.

Applications that we have made on behalf of clients for their Tribunal fees to be repaid, have taken around two months for the ET to process and refund, but if you have paid an ET fee to bring a claim at any point, then this is your money and should be claimed back. Refunds will be paid including interest of 0.5% calculated from the date of the original payment up until the date of the refund.
