Edwin Coe LLP - speed and reliability

Property Litigation

The property Litigation department consists of two partners and a number of assistant solicitors. We work closely with all departments in the firm and in particular our property department, to provide a unique tailored service to all property clients.

The partners also have a strong background in general commercial disputes which ensures they have a wealth of experience to draw upon, to ensure that with a combination of litigation and negotiation, the focus is on achieving the best commercial outcome for clients.

We advise landlords, tenants, multiple national retailers, developers, local authorities and individual property investors, which provides us with an invaluable insight into all aspects of property transactions. Our partners are members of the Property Litigation Association. We have particular experience in landlord and tenant matters and considerable experience of almost every type of property dispute including:

  • Joint venture disputes
  • Nuisance claims
  • Professional negligence claims
  • Conveyancing disputes
  • Rent and service charge recovery
  • Insolvency of landlords and tenants
  • Breaches of covenant
  • 1954 Act contested and uncontested Lease renewals
  • Dilapidations claims
  • Interpretation and rectification of property related documents
  • Boundary and rights of way disputes
  • Forfeiture and applications for relief
  • Lease surrender
  • Securing possession from squatters and gypsies
  • Residential possession
  • Leasehold and enfranchisement – applications for lease extension and for the right to manage

We also have considerable experience in all kinds of dispute resolution and in every case we discuss with our clients ways in which this may assist to bring about an early resolution.
